MPD Traffic Stop Leads to Man's 4th Drunk Driving Charge

A Waterford man is facing his fourth charge of operating a vehicle with a prohibited alcohol concentration in the last five years following an arrest by a Muskego police officer Wednesday.

The felony carries a maximum sentence of six years in prison and a $10,000 fine.

According to a criminal complaint filed Thursday in Waukesha County Circuit Court, 46-year-old David Lewis was driving a van southbound on North Cape Road when an officer ran a routine check on the license plate. It revealed that the van was registered to Lewis, whose license was revoked for prior convictions.

The Muskego officer pulled Lewis over just on the Racine County side of the border and questioned him. Lewis admitted he did not have an ignition interlock device installed, leading to his arrest. The officer then detected the odor of alcohol, according to the complaint.

Following field sobriety tests, a breath test registered .051. Lewis admitted he drank two or three beers during lunch, about three hours prior to the stop.

Though the reading did not exceed the typical level for drunken driving, prior convictions in 2009, 2010 and 2011 led to the felony charge. He also faces misdemeanor charges of operating while revoked and tampering with/failing to install an interlock device.

He is scheduled for a hearing in Waukesha County Court on March 11.
