Spittin' Mad: Man Charged With 3rd OWI After Driving Erratically, Threatening Patrons and Police

New Berlin man is charged with his third OWI after he allegedly hits barriers on I-43 then continues to a Muskego bar after nearly hitting another car and dump truck, spitting on police when they arrive.

A 24-year-old New Berlin man is facing multiple charges after he allegedly drove drunk to a Muskego bar, then spit on two cops before threatening to shoot police officers with a shotgun and blow up one of the officer’s homes with a pipe bomb.

Kyle J. Dolezar was charged in Waukesha County Circuit Court Monday with one count of third offense operating while intoxicated, two counts of discharing bodily fluids towards a public safety officer, one count of resisting an officer and one count of disorderly conduct. If convicted, he faces up to nine years in prison and $33,000 in fines.

Around 3 p.m. Friday,  Dolezar left the Varsity Club tavern near 124th Street and Beloit Road in New Berlin, then got onto I-43 and drove southbound towards Muskego. While west of Moorland Road, a man and his girlfriend spotted Dolezar driving erratically and bounching his car off of concrete barriers and hitting an orange construction barricade before getting off at Racine Avenue. The couple called 911 and followed Dolezar, who nearly hit another car, forcing it to drive up onto a curb, then nearly hit a dump truck heading northbound on Racine while he turned eastbound onto College Avenue.

Dolezar then drove to the where he got out of his car and began to argue with a woman in a blue car. After telling him she had contacted police, Dolezar began to call the woman fat and got into her face before the man who had been following his car got between them.

Patrons from the bar then came outside and began to confront Dolezar, who then took something out of his car and whipped it into a wooded area before police arrived, according to the report.

When officers got to the scene, they tried to put Dolezar in handcuffs, but he began to resist and continued to resist while they tried to frisk him for weapons. The report stated he then told the officers he owns a shotgun and would use it to kill them.

He was placed in the back of a squad car where he began to spit on the windows, ceiling and plexiglas divider, then began to try and kick out the windows. Muskego police officers then had to call New Berlin police officers to assist in the arrest and bring a transport van so they could take Dolezar in.

While placing him in a restraint chair Dolezar continued to tell the officers he wanted to shoot them with his shotgun and told another officer he would blow up his house with a pipe bomb.

Officers eventually had to place a spit hood on Dolezar, but while taking him to Waukesha Memorial Hospital he was still able to spit on two police officers and the steering wheel of the van.

Dolezar was previously convicted of OWI in 2007 and 2009. He’s currently free on $10,000 bond while awaiting trial.
