Controversial incumbent Kathy Nickolaus up for re-election in November 2012, but there are hints of a primary election.
Waukesha County Clerk Kathy Nickolaus may face a primary opponent if she seeks re-election in 2012. Keith Best, who is in charge of public relations with the Republican Party of Waukesha County, said in a comment on Patch that not all area Republicans are happy with her performance. "Nickolaus will be primaried," Best wrote in the comment. "Once again the voters will decide." Nickolaus made national news this spring when she failed to release the City of Brookfield's results from the hotly contested state Supreme Court race between David Prosser and JoAnne Kloppenburg. The mistake led to a state investigation into what happened on the April 6 election night. The Government Accountability Board cleared Nickolaus of criminal misconduct. …

Updated 4:55 p.m. with Kloppenburg campaign statement: An independent probe into Waukesha County Clerk Kathy Nickolaus found she likely violated state elections laws in her bungled release of state Supreme Court election results in April, but her conduct was not willful or criminal. Nickolaus failed to release the City of Brookfield's results on election night for the hotly contested race between incumbent Justice David Prosser Jr. and challenger JoAnne Kloppenburg. Adding the city's 14,315 votes two days later flipped the winner from Kloppenburg to Prosser in a race that became enveloped in the controversial clampdown on public employee collective bargaining rights. Kloppenburg had declared victory on election night with a 204-vote lead …

Waukesha County recount concluded Friday, giving incumbent lead over Assistant Attorney General JoAnne Kloppenburg.
The Government Accountability Board declared incumbent Justice David Prosser as the winner of the state Supreme Court race following a lengthy recount of the ballots cast in the April 5 election. Prosser received 752,694 votes to his challenger, Assistant Attorney General JoAnne Kloppenburg, who received 745,690 winning by .46 percent of the vote, according to the GAB. The recount gained 371 votes for Prosser and 683 votes for Kloppenburg, according to the GAB. The change wasn’t enough for Kloppenburg to recover the difference of 7,004 votes between the two candidates. Kloppenburg had declared victory when reports April 6 showed she was ahead by about 200 votes. However, Waukesha County Clerk Kathy Nickolaus left out of her report to the …

The Waukesha County Board of Canvassers has counted about 11,000 votes after 4 1/2 days. Deadline to complete the county's 125,000-vote recount is May 9.
With one week before the recount deadline, Waukesha County has nearly 10% of its votes recounted, resulting in a net change of 12 additional votes for incumbent state Supreme Court Justice David Prosser. The Waukesha County Board of Canvassers had counted about 11,000 of the county's 125,070 original votes cast, as of mid-day Monday. About 48% of all votes statewide had been recounted as of 12:50 p.m. Monday, or 718,230 votes of the approximately 1.5 million cast, according to the state Government Accountability Board. That did not include votes from 27 reporting units that were being reviewed by state elections officials. May 9 is the deadline for completing the recount, which was requested by challenger JoAnne Kloppenburg after she lost …

Racine and Waukesha counties also among those with outdated software that lacks memory to hold both original and recount votes.
A three-year delay in federal approval of updated ballot-counting software means the upcoming Supreme Court recount will cost Milwaukee County as much as $500,000 more than it would had the software been approved. The county has had $200,000 in its budget to buy the new software since the purchase was approved in 2008, said Lisa Weiner, elections administrator for Milwaukee County. “We have had to roll over the money for the past three years," Weiner said. "I’m not sure that we will be able to do it again if the software is not approved.” All or parts of 31 of the state’s 72 counties use the same outdated software and are awaiting approval to purchase the same new system. Racine and Waukesha counties are also affected. The cost estimate is…

Kathy Nickolaus is asking Government Accountability Board and county auditor to help make changes to practices and procedures in her office.
A heavily criticized Waukesha County clerk said in a prepared statement Tuesday she will not quit despite calls for her resignation from the chairman of the Waukesha County Democratic Party. The clerk, Kathy Nickolaus, has taken heat for not counting the city of Brookfield in the election night figures given to the media April 5. Because Brookfield was not included, it appeared state Supreme Court candidate JoAnne Kloppenburg had taken the lead over incumbent David Prosser. When the mistake was discovered during the Board of Canvassers, the results put Prosser above Kloppenburg by about 7,500 votes in an election that some where calling a referendum on Gov. Scott Walker’s controversial budget repair bill legislation. “I will serve the …
Waukesha County Democratic Party Chairman Victor Weers on Tuesday said County Clerk Kathy Nickolaus should resign immediately due to her lack of transparency, accuracy on election reporting.
The Waukesha County Democratic Party on Tuesday called on Waukesha County Clerk Kathy Nickolaus to resign, saying she has failed to be transparent and trustworthy in her handling of election results. Nickolaus' office staff said she plans a response this afternoon but did not know when or how that response will be delivered. It is also unknown the content of Nickolaus' response. In a statement issued Tuesday, the party's chairman Victor Weers said Nickolaus had "willfully ignored pleas to repair her broken reporting process in an open and technologically reliable way. "Reporting of votes must be as transparent and secure as possible so that the public feels good that their vote will count," Weers said. "Ms. Nickolaus has consistently …

Kathy Nickolaus has seen "human error" from her office during prior elections.
With Waukesha County Clerk Kathy Nickolaus announcing she made an error on election night, which flipped the results of the Wisconsin Supreme Court race to favor incumbent Justice David Prosser, some residents are asking questions as to how often this happens. But for Nickolaus this isn’t the first time she has found herself embroiled in controversy. In 2010, Nickolaus and Waukesha County Board Chairman Jim Dwyer and county Department of Administration officials feuded about an audit of her election system. The audit stated Nickolaus is keeping election results on a personal computer as opposed to a county system. Nickolaus said she kept the results on the personal computer because of security concerns she had with the network. She and …

State Supreme Court candidates campaign manager says group is comparing poll data to voting machine tapes.
Officials from the JoAnne Kloppenburg campaign are taking a look at Waukesha County ballot tapes to make sure there are no inconsistencies. More than one dozen Kloppenburg campaign officials started to review ballots with Waukesha County Clerk Kathy Nickolaus, who on Thursday announced she made an error and forgot to report more than 14,000 votes, which took away a narrow victory margin from Kloppenburg and gave a stronger lead to incumbent Justice David Prosser. “We’re looking at the polling place data to compare it to the tapes and see if the numbers match up,” said Melissa Mulliken, campaign manager for Kloppenburg. “We’re looking to see if we will find any irregularities.” Staffers reviewed the tapes Friday afternoon and they are …

County clerk failed to properly save the City of Brookfield's votes to her countywide total, an error that could mean victory for Prosser.
In a stunning development that instantly changed the race for the state Supreme Court, a county clerk's error on election night added 7,582 votes for incumbent Justice David Prosser over challenger JoAnne Kloppenburg. The additional votes almost certainly will give Prosser the victory in the heated race for the high court. As of early afternoon Thursday, Kloppenburg had been ahead in the race, according to totals compiled by the Associated Press. The additional votes for Prosser were found after it was determined that all the votes for the City of Brookfield were not included in the initial counts that the county provided to the Associated Press, which has been maintaining a statewide tally of votes. The revised Waukesha County figures …
